These Terms of Use (“Terms”) govern your access to and use of HOÏS Medikaplant websites, applications, membership services, educational programs, wellness tools, artificial intelligence features, digital content, community areas, appointments, and related services.

By accessing or using the Platform, creating an account, enrolling in a program, or purchasing a service, you agree to these Terms.

If you do not agree with these Terms, do not use the Platform.

HOÏS Medikaplant is an educational and holistic wellness ecosystem focused on subjects that may include:

The Platform may also connect users with products and services offered through Medikaplant.

2. Educational and Traditional Wellness Purpose

Information available through HOÏS Medikaplant is provided for educational, informational, cultural, and traditional wellness purposes.

Information provided through the Platform should not be considered medical diagnosis, medical treatment, medical prescription, emergency medical care, or a substitute for professional healthcare.

Herbal Wellness Appointments are provided within the framework of MTA — Medsin Tradisyonèl Ayisyen.

Unless expressly identified otherwise, Medikaplant representatives are not acting as medical doctors.

We do not diagnose medical conditions or prescribe prescription medication.

Users should continue appropriate medical follow-up with licensed healthcare professionals.

3. Emergency Situations

HOÏS Medikaplant is not an emergency medical service.

Do not use the Platform, AI tools, messaging systems, or Herbal Wellness Appointments for medical emergencies.

If you believe you are experiencing a medical emergency, contact the appropriate emergency service or qualified healthcare provider in your location.

4. Eligibility

You must have the legal capacity to enter into these Terms.

Certain paid services, memberships, appointments, wellness tracking features, or purchases may require users to be at least 18 years old.

Parents or guardians are responsible for supervising minors who access any content legally available to them.

5. Accounts

Certain services require an account.

You agree to provide accurate information and maintain the confidentiality of your login credentials.

You are responsible for activity occurring through your account unless unauthorized access is promptly reported to us.

You may not:

Share account credentials in violation of membership rules
Impersonate another person
Create fraudulent accounts
Attempt to bypass Platform security
Allow unauthorized persons to access paid content through your account

HOÏS Medikaplant may suspend accounts where fraud, abuse, unauthorized sharing, or violations of these Terms are reasonably suspected.

Create competing products based substantially on HOÏS proprietary materials

The Platform may provide tools allowing users to record activities such as:

Herbal routines
Wellness goals
Blood glucose readings
Daily activities
Progress or streak information

These tools are provided for personal wellness tracking and educational purposes.

HOÏS Medikaplant does not independently verify information entered by users.

Users remain responsible for medical monitoring and clinical interpretation of medical measurements.

9. Artificial Intelligence Features

HOÏS Medikaplant may provide AI-powered assistants or other automated tools.

AI-generated responses:

May be inaccurate
May be incomplete
May misunderstand context
May not reflect the latest scientific information
Should not replace professional judgment

AI outputs are provided for informational and educational assistance only.

Users should independently verify important information before relying upon it.

10. Herbal Information

Traditional plant use does not automatically establish that a plant is safe or medically effective for every person.

Botanical products may interact with:

11. Purchases and Payments

12. Refunds

Purchases are subject to the HOÏS Medikaplant Refund & Cancellation Policy.

13. Appointments

Herbal Wellness Appointments may be conducted through Zoom or another approved communication platform.

Connection information may be sent to the email address submitted during booking.

Where permitted by Medikaplant, WhatsApp may be used in certain circumstances when requested in advance.

The client is responsible for:

Providing accurate contact information
Joining the appointment on time
Maintaining adequate internet access
Using the correct meeting information
Providing requested documents when appropriate

14. Community Conduct

Where the Platform provides community areas, comments, groups, or interactive services, users must behave respectfully.

Users may not use the Platform to:

Harass or threaten others
Publish unlawful content
Promote fraud
Distribute malware
Attempt unauthorized access
Post another person's confidential information without authorization
Engage in spam
Misrepresent their identity
Exploit Platform members
Advertise unauthorized competing services
Violate intellectual-property rights

We may remove content or restrict accounts for violations.

15. User-Submitted Content

When users voluntarily submit comments, reviews, testimonials, images, educational discussions, or other content to public or community portions of the Platform, they retain ownership of their original content.

By submitting content intended for publication, users grant HOÏS Medikaplant a non-exclusive license to host, display, reproduce, and distribute that content as reasonably necessary to operate and promote the Platform, subject to applicable privacy laws and any additional consent requirements.

Private health or appointment information will not be treated as public promotional content solely because it was provided to Medikaplant.

16. Intellectual Property

The HOÏS Medikaplant name, Medikaplant name, logos, branding, original articles, videos, courses, graphics, software, educational materials, databases, Platform designs, and other proprietary materials may be protected by intellectual-property law.

Except where expressly authorized, users may not reproduce, sell, distribute, modify, scrape, republish, or commercially exploit HOÏS Medikaplant content.

17. Prohibited Automated Use

Unless expressly authorized in writing, users may not use bots, scrapers, automated extraction tools, AI training systems, or similar technologies to systematically copy or extract proprietary HOÏS Medikaplant content.

HOÏS Medikaplant may integrate with or link to third-party services, including:

Zoom
Shipping providers
Email services
Analytics services
Hosting platforms
Social networks

Third-party services operate under their own terms and policies.

HOÏS Medikaplant is not responsible for a third party's independent actions, availability, or policies.

19. Platform Availability

We attempt to maintain reliable access but do not guarantee uninterrupted service.

Third-party outages

Events outside our reasonable control

Features may be added, modified, suspended, or removed as the Platform evolves.

20. Disclaimer of Warranties

HOÏS Medikaplant does not guarantee that:

Any wellness practice will produce a particular result
AI-generated responses will always be accurate
The Platform will always operate without interruption
A particular herbal product or routine will produce a specific health outcome

21. Limitation of Liability

To the maximum extent permitted by applicable law, HOÏS Medikaplant and its owners, affiliates, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.

Nothing in these Terms excludes liability that cannot legally be excluded.

22. Indemnification

To the extent permitted by law, users agree to indemnify and hold harmless HOÏS Medikaplant and its representatives from claims resulting from:

Violation of these Terms
Violation of another person's rights
Fraudulent activity
Unauthorized redistribution of protected content

23. Suspension and Termination

Abuses another member

Termination does not automatically entitle a user to a refund.

These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and any additional terms presented for a specific service, constitute the agreement governing use of the Platform.
